GAME BREEDERS

Issued for: possession of all nonmigratory game birds and wild animals

Possession Legal:

  • Fur-bearing mammals: beaver, coyote, gray fox, red fox, mink, muskrat, opossum, raccoon, striped skunk, long-tailed weasel (wild-caught or captive-born)
  • Ring-necked pheasant (captive-born)
  • Bobwhite quail (captive-born)
  • Eastern cottontail rabbit (wild-caught or captive-born)
  • Gray squirrel (captive-born)
  • Fox squirrel (captive-born)
  • Least weasel


Breeding Legal:

  • Fur-bearing mammals
  • Gray squirrel
  • Fox squirrel
  • Eastern cottontail rabbit


Breeding/Food/Release Legal:

  • Ring-necked pheasant (if not diseased)
  • Bobwhite quail (if not diseased)


REQUIREMENTS:


  • Required within 5 days after open season for wild animals from the wild during open season and within 5 days of acquisition or importation of game bird or wild animals from a breeder
  • Allows import of animals raised domestically by out-of-state breeders for any purpose [was food purposes] – need proof of origin
  • BANS use of drug, vaccine or other chemical on animals without permit
    • Allows pharmaceutical products approved by an agency
    • May NOT alter normal reproductive functions
  • Pre-permit inspection
  • Adding species requires inspection or approval by division – must notify within 5 days of acquisition
  • Import of live animals or eggs requires certificate of veterinary inspection or certificate of compliance along with copy of breeder license or valid dated receipt
  • Allow inspection of receipt, invoice or other evidence of lawful acquisition upon request
  • Ring-necked pheasants, bobwhite quail, furbearing mammals, eastern cottontail rabbits, fox squirrels, and gray squirrels must meet listed caging and care requirements
  • Allows administering pharmaceutical product approved by agency to prevent or treat malnutrition, illness, disease, injury or stress – vets may administer immobilizing agent, tranquilizer, or euthanasia
  • BANS sale of diseased animals
  • Comply with all laws
  • Maintain inventory and records all births, deaths, sales, trades, loans, barters and give aways that change the inventory
  • Valid, dated receipt for all animals sold, traded, bartered or gifted with license number, buyer and seller name and address, number sold, and species sold – must keep 5 years
  • Annual report of each species
  • Allows inspections along with 2nd inspections at least 15 days later for violations

SCIENTIFIC PURPOSEs license

Sale/Barter/Trade: BANNED

REQUIREMENTS:

Application:

  • Purpose for, species and numbers, location, and method of taking
  • Intent to administer any drug, vaccine, steroid, microorganism or other chemical for take
  • Intended treatment any proposed genetic modification
  • Disposition of animal
  • Signatures of 2 scientists with degree in biological sciences  and signature of faculty biologist for that group if pursuing bachelor’s degree (new license only)
  • May issue conditions such as species and number, location and method, seasons and location of take and disposition and migratory birds – must provide written notification first
  • Properly accredited individual for scientific purpose including education that has bachelor’s degree in biological science or related field, is pursuing one, holds federal permit, performing activity upon request of accredited educational or scientific institution, or sponsored by department to protect wild animal populations
  • Must be affiliated with either 1) a public school, recognized nonpublic school or college or university, 2) government agency associated with biological or scientific study, 3) 501(c)(3) nonprofit educational organization associated with biological or scientific study, 4) scientific research organization, accredited museum, or institution of higher learning, consulting firms, with a college, university, or government agency, or private company


Others:

  • Comply with monitoring, tagging, and reporting requirement for extra-label drug use
  • Allows assistant
  • Must obtain permission from landowners or public land property manager
  • Report of collection within 60 days of expiration
  • Allows pharmaceutical products approved by an agency
  • Allows altering normal reproductive functions

FIELD trial permit

REQUIREMENTS:

  • Must be sanctioned trial under recognized national or regional hunting dog association rules
  • Must apply at least 10 business days before trial
  • Keep permit and roster of participants at trial headquarters during event and present upon request
  • Carry card with permit number and name and address of participant
  • Must be in season except with permission 
  • May NOT alter normal reproductive functions

REhabilitation LICENSE

Issued for residents to temporarily rehabilitate mammals, birds, reptiles and amphibians


Possess (during rehabilitation): Up to 180 days except

  • Exception granted by department (excludes trying to release outside of season)
  • Migratory birds must follow federal permit
  • Turtles with shell fractures allowed 2 years if housed separately


Possession (nonreleaseable based on vet evaluation): White-tailed deer BANNED

  • Educational purposes with Special purpose educational permit
    • Mammals: Wild animal possession permit
      • 12 or less programs/year: 3 per species and 6 total
      • 13+ programs: 5 per species and 20 total
      • Exceptions may be granted

Euthanasia Required:

  • Turtles with shell fractures not able to be treated in 2 years


REQUIREMENTS:

Application:

  • 18+ years old
  • Documentation of 1 year of experience with veterinarian with wild animal rehabilitation permit, zoological park, university animal clinic, wild animal rehabilitator permitted for 3 years
  • Name and address of veterinarian willing to treat (must sign application)
  • List of wildlife rehabilitation reference books held including 1 that includes information on each species and is on approved list
  • Name, address and phone number of any assistants
  • Species and animal types
  • Description of facility, equipment and supplies with internal dimensions and floor, wall and perch materials along with cages, ICUs, aviaries, medical supplies and other items
  • At least 80% on written exam on basic biology, care and laws
    • May retake up to 2 times within 90 days – must wait 180 days after 3rd failure
    • EXEMPT: Permit holders for 10 years with 12 animals/year 
  • Allow pre-permit inspection
  • Follow rules for carcasses


Assistants:

  • At least 16
  • Under direct supervision if under 18
  • If 18:
    • Possess wild animal at location not authorized on permit for 30 consecutive days with authorization
    • Permit holder is responsible for care
    • Permit holder provides supervision with written instructions and is available by phone
    • Assistant facilities meet same standards
    • Returned to permit holder at time of weaning or release


Other:

  • Retake exam every 3 years or complete 8 hours of continuing education
    • EXEMPT: Permit holders for 10 years with 12 animals/year 
  • Allow regular inspections
  • File amended application for change to address, assistant, or number of species
  • Annual report kept 3 years with any renewals with species and condition, date received, name and county of donor or source, method, location and date of disposition

  • Notify Department within 24 hours if reason to believe part of criminal activity

SPECIAL PURPOSE EDUCATIONAL PERMIT

Limited to:

  • rehabilitator
  • falconer
  • wild animal possession permit
  • educational institution whose primary function is conservation education
  • nonprofit organization
  • employee or sponsor of educational institution or nonprofit organization
  • USFWS special purpose possession permit for nonreleasable migratory bird


Public Contact Legal:

  • Reptile not venomous or endangered


REQUIREMENTS:


Applications:

  • Documentation with license, permit, receipt or rehabilitation report showing lawful acquisition
  • Animal is permanently injured and nonreleaseable (if obtained from rehabilitation permit)
  • Educational program outline that explains legal acquisition
  • Education program that promotes survival and role of wild animals in natural habitat, promotes understanding of ecological needs of wild populations and does NOT promote opposition to scientific management of wildlife including regulated taking
  • USFWS special purpose possession permit for migratory birds


Other:

  • Must handle, house and transport in safe, sanitary, humane way that prevents escapes
  • Must NOT maintain or display in manner that poses public safety or property hazard, harms health of animal, or violates the law
  • Annual report with numbers and species, program dates and locations, and who program was given
  • Maintain records for 2 years after expiration
  • Allows inspections

NUISANCE WILD ANIMAL CONTROL PERMIT

Issued for: control nuisance animal causing or threatening to cause property damage or posing human or domestic animal health or safety threat (must be immediate for black bear)

NOT issued for: migratory birds except mute swans or if in violation of federal law

Issued to: property owners or lessees or someone who charges a fee or provides service to the public

Possession: Limited to 48 hours

Sale/Trade/Barter/Gifts: BANNED including for hides and carcasses

  • Allows gift to accredited scientific or educational institution with special purpose salvage permit and to department if tagged


Take Methods Legal: Must check traps every 24 hours and remove animals within 12 hours

  • Firearms
  • Steel and live traps (exceptions listed)
  • Snares (circumference up to 15” except when 50%+ covered by water or snare lock)
  • Method allowed on permit


Release/Treatment:

  • If on-site not option: must be released in county with landowner consent, euthanized or treated
  • Must attempt to capture and relocate endangered species in appropriate habitat or euthanize with permission
  • Bear carcass taken must be given to Department within 7 business days
  • Notification within 24 hours of taking more than 5 bats from 1 site Jun 1 – Jul 31


Exams:

  • Score at least 80% of written exam of basic knowledge (landowners exempt)
    • May retake 1 time within 45 days and then wait 180 days after that
    • EXEMPT: those with permit 25 years
  • Pass exam again or complete 16 hours of continuing education every 4 years (landowners exempt)


Other:

  • Allows landowners to have unpermitted assistant if supervised and permit present
  • Must be handled to prevent unnecessary injury
  • Maintain records for 2 years of name and address of landowner assisted, date assisted, number and species, method of disposition, name and address of landowner where released
  • Annual report with number and species taken, county, method of disposition, name and address of landowner released
  • Allows retaining or gifting meat for personal consumption if tagged
  • Need landowner or tenant permission to set up trap or snare or capture on their property
  • Allow inspections

FUR BUYERS LICENSE

Issued for: engaging in business of buying furbearing mammals, river otters, badgers, and bobcats or their untanned hides, skins or furs.


REQUIREMENTS:

  • Allows possessing carcasses and untanned hides taken through Jun 30 of expiration year
  • Must document date and method of acquisition of hide or carcass of bobcat or badger by obtaining copy of tag, receipt, hunting or trapping license, permit or other record from seller
  • Record date and method for all other wild animals
  • Need signed report of species, number and locations of furs or carcasses after Jun 30 of expiration year
  • Issue receipt for sales, trades, barters, and gifts with license number, names and addresses of buyers and sellers, and number and species of animals
  • Allow inspections

FALCONRY LICENSE

APPRENTICE CLASS:

Possession Legal: 1 raptor (BANS taking eyass from wild and imprinted ones)


  • First (must be one they caught)
    • wild American kestrel
    • wild red-tailed hawk
  • After 6 months (wild or captive-bred)
    • American kestrel
    • red-tailed hawk
    • Harris's hawk


General:

  • Be at least 12 years old
  • Have cosigned by parent or guardian if under 18
  • Document signed and dated by general or master class sponsor that is at least 18 with 2 years of experience
  • Has procedure for sponsor termination
  • Meet exam requirement
  • Have raptor housing facility inspected


GENERAL CLASS:

Possession Legal: 3 Falconiform or Strigiform (wild, captive-bred or hybrid) except:

  • federal threatened or endangered species
  • bald eagle
  • white-tailed eagle
  • Steller's sea eagle
  • golden eagle


General:


  • Be at least 16 years old
  • Have cosigned by parent or guardian if under 18
  • Document signed and dated from apprentice sponsor of 4 months of each of last 2 years practicing falconry including hunting, capture and release


MASTER CLASS:

Possession Legal: any Falconiform or Strigiform except bald eagle

  • 5 wild raptors
  • Unlimited captive-bred if trained to hunt game and used in hunting
  • 1 federal endangered or threatened species
  • 3 combined total golden, white-tailed or Steller’s Sea eagles
    • Need approval by submitting experience of handling large raptors and 2 reference letters of their experience with large raptors and assessment of applicant’s ability to


General:

  • Must practice falconry 4 months of each of last 5 years under general including hunting


ALL CLASSES:

Take Legal: (BANS federal and state endangered or threatened species)

  • 2 raptors total annually
  • Out-of-state general or master falconer
  • 1 eyass annual by general and 2 eyass by master until Aug 1 if 1 stays in nest
  • Passage birds Sep 1 to last day of Feb
  • American kestrel and great horned owl over 1 year at any time
  • Immature or subadult golden eagle in livestock depredation area by master class
  • 1 federal threatened raptor annually by master class if take allowed in area and federal endangered species permit obtained
  • By other than license holder
    • License holder present: without license and counts take on their license and fulfills banding and marking requirements
    • License holder NOT present: with general or master class AND fulfills banding requirements along with any person transferred to
    • License holder long-term/physical impairment: with general or master class if license holder meets banding requirements and counts in take
  • unbanded, juvenile peregrine falcon by master class under federal limits and seasons
  • directly from rehabilitator if counted in take at discretion of rehabilitator
  • raptor with Federal Bird Banding Laboratory aluminum band (except peregrine falcon that must have research band and released) that complies with limits above and reports it to them
    • Those with transmitter may be kept 30 days to contact researcher and get permission to replace the transmitter or batteries and remove it (removed one is legal to possess)


Take Requirements:

  • BANS intentional take of prohibited raptors
  • Must not violate law of landowner trapping on
  • Immediately release any unintentionally caught or illegal raptor
  • Count raptors taken even if transferred to another license holder in same year
  • Injured raptors must either 1) be put on license, counted toward take, meet banding requirements and treated, or 2) given to veterinarian, rehabilitator, or department employee


Recapture Legal:

  • Those with band, transmitter or equipment showing it is falconry raptor who report it within 5 working days, returns it to person who lost it, or disposes of it if ownership not determined (does not count toward limits and not considered to be wild)


Transfer Legal: Unlimited allowed up to possess limit per class

  • Captive-bred raptor with band or microchip to someone authorized to it (allows sale, purchase, barter, trade)
  • raptor propagation permit
    • sharp-shinned hawk, Cooper's hawk, Merlin or American kestrel after 1 year of falconry
    • all other wild raptors after 2 years of falconry
  • Another permit type if injured with vet or rehabilitator certification that it can no longer do falconry
  • Surviving spouse, executor, administrator or representative transferring to another license holder within 90 days of death of license holder


Permanent Release Legal: BANS non native and hybrids

  • Native captive-bred with written permission and hacking it
  • Wild-caught native raptor at appropriate time and location if leg band removed and returned to department


Captive Propagation Legal:

  • USFWS raptor propagation permit
    • Not required to transfer from license if used less than 8 months in 12
    • Must permanently transfer to raptor propagation permit and band if longer


Falconry Practices Legal:

  • Use of creance (tethered) flying, lures, balloons and kites
  • hacking with written approval if:
    •  counted in possession limit
    • authorized to possess it
    • department contacted to make sure it is not near federal endangered or threatened bird nesting area or near another area where it is likely to harm them
  • Free flight of hybrids raptors with 2 functioning radio transmitters (BANS slitted style mew jesses of any raptor)
  • Hunt wild animals with raptors under listed requirements
  • Possess wild animal taken by raptor
  • Give away parts or carcasses of wild animal taken by raptor for free if tagged
  • Abatement (paid or unpaid) by master class with USFWS special purpose abatement permit and by general class as subpermittee of special purpose abatement permit
  • Hunt species with raptor under federal depredation orders for free
  • Flying raptors and take pen-raised ring-necked pheasants and northern bobwhite quail released for training on dog training ground, shooting preserve or during season
  • Conservation education programs with special purpose educational permit if fee paid (exempt if free) including use of taxidermies
    • Apprentice must be under direct supervision
    • Used primarily for falconry
    • Contain raptor biology, ecological roles, conservation needs
  • Allow photographs, films or visual depictions to create information on falconry, raptor biology, ecological roles and conservation needs for free
  • Promote nonprofit falconry organization or association, materials, equipment, products or endeavors related to falconry and scientific research
  • Assist rehabilitator under conditions listed
  • Manage raptor feathers as provided
  • Dispose of carcasses as provided


Practices Banned:

  • Making movies, commercial entertainment, commercials or ads or commercial ventures not falconry related
  • Promoting products, merchandise, goods, services, meetings or fairs
  • Representing business, company, corporation or organization


Lapsed License:

  • If less than 5 years, can reinstate at same level
  • If more than 5 years, can reinstate at same level with exam and proof of prior held class
  • Not allowed during suspension or revocation period


 
REQUIREMENTS:

  • Need hunting license to take wildlife and stamp if required
  • Allows pharmaceutical products approved by an agency
  • May NOT alter normal reproductive functions
  • Those who reside in US 60 days to 2 years may qualify for license appropriate to experience with the exam, inspection of facility and documentation of experience
  • Those in state 160 days but no primary residence must obtain license in 120 days, have license in resident state and possess only number and species listed on out-of-state license
  • Notify department and permitting authority of new jurisdiction within 30 days before moving raptors outside department jurisdiction
  • If moving into state, must notify department and apply for license within 30 days
  • Must score at least 80% on exam covering biology, care and handling and laws
    • May retake 1 time within 45 days but must wait 180 days after that
  • Follow banding and reporting requirements
  • Meet housing facility and equipment requirements
  • Allows inspections
  • Follow requirements for caregivers
  • Allows using delisted federal endangered and threatened if take is authorized in and follows management plan
  • Allows assistant if not paid or handled except flying practice under direct supervision

  • nature center, nonprofit organization, or educational institution

  • salvage dead wild mammal, reptile, amphibian, or bird if didn’t cause it
  • food, science, education, or a similar purpose if approved


REQUIREMENTS:

  • Include purpose for salvage on application
  • Tag each animal with date and country salvaged and person who did it
  • Obtain landowner or public land property manager before salvage
  • Deposit animal at approved location within earliest of 6 months or end of year and deliver unused to conservation officer or disposed of on permit
  • USFWS permi to salvage migratory bird, parts, nests or eggs
  • Listing of each animal and date and location annually kept for 2 years
  • Comply with laws

Exempt from permit:

  • fish hauler's and supplier's permit
  • fish importation permit
  • production, import or sale for aquarium pet trade if not invasive
  • confinement and exhibition in a zoo or another public display if not invasive


REQUIREMENTS:

Triploid Grass Carp:

  • BANS stocking in public waters except fish stocking permit
  •  Seller must deliver and stock fish
  • Copy of bill of sale and triploidy certification conveyed to buyer and retained by buyer and seller 2 years
  • Quarterly report by 15th day of month
  • Allow inspections – limit 6 fish from lot or truck removed to verify chromosome numbers


Diploid Grass Carp by Aquaculture Permit:

  • Not stock in public or private waters except under fish stocking permit
  • Possess live ones only to produce triploid or diploid capable of producing triploid
  • Diploid may only be sold to another permit holder
  • Hold in closed aquaculture system
  • Annual report
  • Accurately determine number of sets of chromosomes under USFWS certification

FISH TAGGING OR MARKING PERMIT:


Issued to: tag or mark fish and release in public waters

Exempt: Scientific purposes license

REQUIREMENTS:

  • Apply at least 21 days before tagging or marking
  • Provide name/address/phone, name of waterway and county for tagging; species, size and number of fish; dates; reason
  • Have permit during activities
  • Meet any department specifications and conditions
  • Allows withdrawal for resource protection or management purposes
  • Report within 15 days of expiration with marking and tagging by species, number and size of fish and location

DOG TRAINING GROUND PERMIT:


Issued for: take captive-bred northern bobwhite quail or ring-necked pheasants to train dogs

REQUIREMENTS:

  • Own or control at least 5 to 20 contiguous acres
  • Not be within 1 mile of state-owned or -controlled public hunting area
  • Limit 1 per contiguous tract of land
  • Mark boundary of land with signs at least 16” wide x 16” long with white background and 1” lettering stating “Dog training ground” within 500 feet of each other
  • Allow inspections
  • Use of ground for field trials and shooting preserves and breeding game birds for release require those permits


Release:

  • Metal or plastic leg band
  • Bill of sale for game birds or copy of game breeder license
  • Daily record of training activities including name and address of trainers, number and species released and taken


Take:

  • BANS sunrise to sunset


Sale/Possess:

  • game breeder license after 5 days

SHOOTING PRESERVE LICENSE:


REQUIREMENTS:

Mark boundaries of land with clearly visible signs 18” wide x 12” long with white background and 1” lettering with “licensed shooting preserve” every 500’


 



MIGRATORY BIRD DEPREDATION PERMIT:


Issued for: take migratory bird causing damage to property or posing human or domestic animal health or safety threat

Issued to: property owner, lessee, or others

Exempt:

  • During hunting season
  • Brown-headed cowbirds, common grackles, red-winged blackbirds, rusty blackbirds, Brewer's blackbirds, and crows causing depredation
  • Mute swans taken under 9-3-15
  • The following if not endangered:
    • Cormorant
    • Hawk
    • Heron
    • Owl
    • Vulture
    • Woodpecker


Take Methods Legal:

DEER CONTROL PERMIT:


Issued for: take white-tailed deer that is causing or threatening to cause over $500 in property damage annually computed as listed, posing immediate health or safety threat to humans or domestic animals, or affecting management of free-ranging

WILD ANIMAL IMPORT PERMIT:


Issued to: import mammal, bird, reptile, amphibian, crustacean or mollusk for release or sale

EXEMPT:

  • interstate shipment
  • zoo, carnival, menagerie, animal dealer, pet shop, circus, or nature center
  • confinement and exhibit in a zoo or other public display


REQUIREMENTS:

  • Apply at least 10 days before import
  • Must be free of communicable disease, not become a nuisance, and not cause damage to native and domestic species
  • Application with information on health and safe handling, historic status of species in state, goal of release, ability to survive and achieve goal, genetic appropriateness of specimen, public support, anticipated release impact and management

REPTILE CAPTIVE BREEDING:


ISSUED FOR: breeding listed captive-born native snakes.


REQUIREMENTS:


  • Limited to those listed
  • Permit required within 5 days of acquisition
  • Need PIT tag or scale-clipping AND AVID transponder except listed varieties
  • Escape-proof enclosure that is sanitary and humane with ample space
  • Captive-born ones need invoice, bill of lading, or other evidence of lawful acquisition
  • Wild-caught need PIT tag in 14 days
  • Sale of offspring must be before the snakes reach these lengths: 15” for eastern hog-nosed snake; 18” for gray ratsnake, eastern foxsnake, eastern black kingsnake, prairie kingsnake, and eastern milksnake; 28” for bullsnake
    • EXEMPT: Those PIT tagged for breeding stock
  • Annual records kept for 2 years of number and disposition, species and number captured, received, or sold, birth dates of captive-born, and name and address of buyer
  • BANS release of captive breeders and offspring


 


TURTLE POSSESSION:

ISSUED FOR: possessing native turtles


REQUIREMENTS:


  • Be a resident
  • Apply within 10 days of acquiring a turtle
  • receipted invoice, bill of lading or other evidence of lawful acquisition  
  • Allow pre-inspection
  • Must be quarantined for 30 days with no signs of illness before placement with other turtles
  • Cage or enclosure that prevents escape and prevent entry of free-roaming ones with ample space for exercise
  • Handled and transported in sanitary and humane manner
  • Cage mature males and females separately
  • BANS breeding, sale, trade, barter and release
  • May only give away to another permit holder
  • AVID pit tag or another permanent unique identifier for carapace 4”+
  • BANS commercially advertising adoption services and charging fee
  • Allows public display
  • Records kept for 2 years after acquisition of taxa, number, carapace length, and weight of each turtle; name, address, and telephone number of person obtained from; date obtained; PIT tag code or unique identifier
  • Allow inspections and 2nd inspection if any deficiency
  • Annual report with taxa and number of species, date obtained, PIT tag or ID and photo, how obtained
